Terms of Service

Welcome to Baduga Symphony. These Terms of Service ("Terms") govern your access to and use of the Baduga Symphony mobile application and website (the "Service"), operated by Baduga Symphony ("we", "our", "us"). By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

To use Baduga Symphony, you must:

• Be at least 18 years of age.
• Be a member of the Baduga community or be seeking a matrimonial connection within the Baduga community.
• Be legally eligible to enter into a marriage under applicable Indian law.
• Not be currently married (unless legally separated/divorced).
• Be capable of forming a binding contract and not barred from doing so under applicable law.
• Not have been previously banned or removed from the Service.

By using the Service, you represent and warrant that you meet all of the above eligibility requirements.

2. Account Registration & Verification

• You must register using a valid Indian mobile phone number. We use Firebase phone authentication for secure sign-in.
• All profiles are subject to admin verification. You must submit a valid government-issued photo ID (Aadhaar, PAN, Passport, Voter ID, or Driving License) for identity verification.
• Your profile will remain in "pending" status until approved by our admin team. We reserve the right to reject any profile that does not meet our community guidelines.
• You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
• You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3. Community Guidelines & Acceptable Use

Baduga Symphony is a trusted matrimony platform. You agree to:

• Be Respectful: Treat all members with dignity and respect. Harassment, abuse, or intimidation of any kind is strictly prohibited.
• Be Truthful: Provide only accurate and genuine information in your profile. Do not misrepresent your identity, age, marital status, or any other details.
• Protect Privacy: Do not share, screenshot, or distribute other users' photos, personal information, or chat conversations without their explicit consent.

You must NOT:

• Create fake or duplicate profiles.
• Use the Service for any purpose other than genuine matrimonial search.
• Send spam, unsolicited messages, or promotional content.
• Upload obscene, offensive, or inappropriate photos or content.
• Attempt to circumvent screenshot protection or other security measures.
• Use automated tools, bots, or scrapers to access the Service.
• Solicit money or financial information from other users.
• Engage in any activity that violates applicable laws or regulations.

4. Premium Subscription (Pro Membership)

4.1 Subscription Features

Baduga Symphony offers a Pro Membership that unlocks premium features including:

• Algorithm priority and enhanced visibility in search results.
• Verified Gold Badge on your profile.
• Access to view received interest requests.
• Advanced profile analytics (who viewed your profile, interest trends).
• Full, unblurred photo access for all profiles.

4.2 Billing & Payment

• Subscriptions are processed through Apple App Store (iOS) or Google Play Store (Android).
• Payment is charged to your App Store or Play Store account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• The renewal charge is applied within 24 hours prior to the end of the current period at the same rate.

4.3 Cancellation & Refunds

• You can manage and cancel your subscription through your device's App Store or Play Store settings.
• Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until then.
• Refunds are handled by Apple or Google according to their respective refund policies. We cannot process refunds directly.
• Deleting the app does not cancel your subscription. You must cancel through your device settings.

5. User Content

• You retain ownership of the content you upload (photos, text, etc.), but you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Service for the purpose of operating and promoting the platform.
• We reserve the right to remove any content that violates these Terms or our community guidelines without prior notice.
• Admin may request changes to your profile information or photos if they do not meet our quality and authenticity standards.

6. Intellectual Property

The Baduga Symphony brand, logo, design, content, and all associated intellectual property are owned by us. You may not:

• Copy, modify, or distribute any part of our Service without explicit permission.
• Use the Baduga Symphony brand name, logo, or trademarks for any purpose without our prior written consent.
• Reverse engineer, decompile, or disassemble any part of our application.

7. Safety & Reporting

• We encourage all users to report suspicious profiles, inappropriate behavior, or any safety concerns using the in-app reporting feature.
• Reports are reviewed by our admin team, and appropriate action (warning, suspension, or permanent ban) will be taken.
• We cooperate with law enforcement agencies when required to do so to ensure user safety.
• While we verify profiles and monitor for misuse, we cannot guarantee the behavior of any user. Please exercise caution and arrange initial meetings in public places.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Baduga Symphony is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
• We do not guarantee that you will find a match or that the Service will be uninterrupted, error-free, or secure.
• We are not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to damages for loss of data, goodwill, or other intangible losses.
• We are not responsible for the actions, content, or behavior of other users on the platform.
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Baduga Symphony, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another user.

10. Account Suspension & Termination

• We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or our community guidelines.
• You may delete your account at any time by contacting us at support@badugasymphony.com.
• Upon account deletion, your profile, photos, and personal data will be removed within 30 days, subject to our data retention policies outlined in our Privacy Policy.

11. Governing Law & Dispute Resolution

• These Terms are governed by and construed in accordance with the laws of India.
• Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Tamil Nadu, India.
• Before filing any formal legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at support@badugasymphony.com.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through an in-app notification and by updating the "Last Updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
